Resumen : Este informe presenta los hallazgos de una investigación sobre la extorsión comercial y el cobro de piso en Tijuana. Si bien se trata de un fenómeno que puede afectar a cualquiera que forme parte de una cadena de valor, nuestro trabajo se enfoca en los grandes empresarios, las Pymes y los comerciantes de sectores formales e informales de la ciudad fronteriza. Desde México Evalúa, en alianza con el Center for International Private Enterprise (CIPE), the Center for U.S.-Mexican Studies at University of California, San Diego y Global Initiative Against Transnational Organized Crime (GI-TOC), documentamos esta suerte de “impuesto criminal”. Lo hicimos para entender las dinámicas específicas de su ocurrencia; el impacto que tiene en la economía y la vida cotidiana de quienes lo padecen -o temen que así será, eventualmente-; y las respuestas ofrecidas por las autoridades y la sociedad civil para gestionar el fenómeno. El desafío inicial es apremiante. ¿Cómo documentar un delito al que se asocia una cifra negra de alrededor de 97% (ENVIPE, 2022)? En el país, apenas el 3% de los casos se denuncian y, de ellos, prácticamente ninguno motiva una investigación judicial o termina en una sentencia. Nuestro principal hallazgo es el siguiente: para el establecimiento de la relación “cobro de piso-protección”, es central la construcción de un ambiente violento que estimule la necesidad de protección y, con ella, aceptar la oferta de este proveedor criminal de protección: mientras mayor capacidad violenta se atribuya a los perpetradores, más probable es que sus víctimas paguen. Esto puede ser el origen de un ciclo infinito de violencias que no hace más que escalar: el ambiente violento genera necesidad de protección, se abre una oferta de protección en la que los actores criminales son proveedores y estos, a su vez, usan la violencia para garantizar el apego al acuerdo y “sancionar” a quienes no lo respetan. Entonces, alrededor de la extorsión y el cobro de piso, cohabitan diferentes expresiones de violencias y ésta, al mismo tiempo, entraña otras tantas: incendios, homicidios, levantones. ABSTRACT This report presents the findings of an investigation into commercial extortion and piso collection in Tijuana. Although it is a phenomenon that can affect anyone who is part of a value chain, our work focuses on large businessmen, SMEs, and merchants from formal and informal sectors of the border city. From México Evalúa, in alliance with the Center for International Private Enterprise (CIPE), the Center for U.S.-Mexican Studies at University of California, San Diego, and the Global Initiative Against Transnational Organized Crime (GI-TOC), we document this kind of “tax criminal". We did it to understand the specific dynamics of its occurrence; the impact it has on the economy and the daily life of those who suffer from it -or fear that it will eventually-; and the responses offered by the authorities and civil society to manage the phenomenon. The initial challenge is pressing. How to document a crime to which a black figure of around 97% is associated (ENVIPE, 2022)? In the country, barely 3% of cases are reported and, of these, practically none lead to a judicial investigation or end in a sentence. Our main finding is the following: for the establishment of the relationship "charge of floor-protection", the construction of a violent environment that stimulates the need for protection and, with it, accepting the offer of this criminal provider of protection is central: the greater violent capacity attributed to the perpetrators, the more likely it is that their victims will pay. This can be the origin of an infinite cycle of violence that only escalates: the violent environment generates a need for protection, an offer of protection opens up in which criminal actors are providers and these, in turn, use violence. to guarantee adherence to the agreement and "sanction" those who do not respect it. So, around extortion and the collection of a flat, different expressions of violence coexist and this, at the same time, entails many others: fires, homicides, riots.
